Obstructing investments contrary to the principles of community life

If the landowner behaves disloyally towards the perpetual usufructuary, preventing him from starting the agreed investment, he has no right to demand full payment for this usufruct, the Supreme Court stated.

Company V, which is involved in the distribution of films and the construction of cinemas, among other things, concluded a contract with the then municipality of Warsaw-Center in 2000, as a result of which it obtained the right of perpetual usufruct of a plot of land with an area of over 2000 square meters.
